DMCA and Copyright Violation Information
We do not allow our hosting clients or users of our services to infringe on the copyrights or trademarks of others. Please review our hosting terms of services at http://elementalmuse.com/terms.shtml.
If we receive notice under DMCA, we will remove infringing content as soon as possible (please note our business hours), and notify both parties involved. If the material appears to be fair use or otherwise not infringement we may seek immediate qualified legal counsel, and will attempt to respond within 24 hours or on our next business day to the complaint. If a client is the subject of this action more than once, and does not file a counterclaim, their account will be terminated.
Once content has been removed, if the client feels in good faith that the removal was not justified and that they have not infringed on copyrights, the client may contact us with a counterclaim which we will forward to the party who sent the DMCA notice. Within 10-14 days we must receive notice from the party who sent the DMCA notice that a lawsuit has been filed, or the content will be restored.
